Tafsir of Surah At-Tawba 9:12
﴿وَإِن نَّكَثُوا أَيْمَانَهُم مِّن بَعْدِ عَهْدِهِمْ وَطَعَنُوا فِي دِينِكُمْ فَقَاتِلُوا أَئِمَّةَ الْكُفْرِ إِنَّهُمْ لَا أَيْمَانَ لَهُمْ لَعَلَّهُمْ يَنتَهُونَ﴾
Translation of the meaning
And if they break their oaths after their treaty and defame your religion, then combat the leaders of disbelief, for indeed, there are no oaths [sacred] to them; [fight them that] they might cease.

Shaykh al-Islam Ibn Taymiyyah
لم يرد لا تنعقد أيمانهم فإنه قد قال {9: 13 ألا تقاتلون قوما نكثوا أيمانهم} وقال {9: 12 وإن نكثوا أيمانهم من بعد عهدهم} وإنما أراد أنهم لا يوفون بأيمانهم«نظرية العقد = العقود» 1/52Imam Ibn al-Qayyim
فأخبر سبحانه عن سبب القتال - وهو نكث الأيمان والطعن في الدين - ثم أخبر أنه لا أيمان لهم تعصمهم من القتل لأنهم قد نكثوها.«أحكام أهل الذمة» 3/1386
