Tafsir of Surah An-Nisaa 4:8

Translation of the meaning

And when [other] relatives and orphans and the needy are present at the [time of] division, then provide for them [something] out of it [i.e., the estate] and speak to them words of appropriate kindness.

وأما هذه المواضع فالأخذ فيها بالحاجة والمنفعة؛ فلا يجوز أن تكون التسوية بين الأصناف واجبة ولا مستحبة؛ بل العطاء بحسب الحاجة والمنفعة كما كان أصل الاستحقاق معلقا بذلك«مجموع الفتاوى» 19/258
